Acceptance of Terms
These Terms of Service govern your access to and use of the WorkDesk platform, operated by WorkDesk / Tabulated LLC. By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using WorkDesk on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree, do not use the Service.
Description of Service
WorkDesk is a business management platform for professional service businesses, including tools for job scheduling, client management, team communication, photo documentation, SMS notifications, inventory management, and reporting. We reserve the right to modify or discontinue any part of the Service with reasonable notice.
Accounts & Access
You must be at least 18 years old to create an account. You must provide accurate and complete information at signup and keep your password secure. Notify us immediately of any unauthorized access at support@workdeskusa.com. Business owners are responsible for their team members' use of the platform. We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree to use WorkDesk only for lawful business purposes. You may not use the Service to harass or harm any person, upload malicious code or harmful content, attempt unauthorized access to any part of the platform, send spam or unsolicited communications, scrape or reverse engineer the platform, or resell access without our written permission.
SMS Communications
You may not use WorkDesk's SMS features to send spam, unsolicited marketing, or any content that violates TCPA, CAN-SPAM, or carrier guidelines.
As a business using WorkDesk you must obtain proper consent from recipients before sending SMS messages, maintain opt-in records for your clients, include opt-out instructions in all messages (reply STOP), and comply with all applicable laws including TCPA and carrier A2P 10DLC guidelines.
Message and data rates may apply to your recipients. WorkDesk reserves the right to suspend SMS access for any account sending prohibited content.
Your Data
You retain ownership of all data you enter into WorkDesk. By using the Service you grant WorkDesk a limited license to store and process your data solely to provide the Service. We do not claim ownership of your data and will not use it for any other purpose. Upon account termination you may request a data export within 30 days.
Payment & Billing
Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time from your account settings. Contact us within 7 days of a charge if you believe there is a billing error. We reserve the right to change pricing with 30 days advance notice. Failure to pay may result in suspension of your account.
Intellectual Property
The WorkDesk platform, design, code, and branding are owned by WorkDesk / Tabulated LLC and protected by intellectual property laws. The WorkDesk name, logo, and tagline "Your work. One desk." are trademarks of WorkDesk. You may not use them without prior written consent.
Disclaimers
The Service is provided "as is" without warranties of any kind. WorkDesk does not warrant that the Service will be uninterrupted or error-free. You are responsible for evaluating whether WorkDesk is suitable for your business needs before subscribing.
Limitation of Liability
To the maximum extent permitted by law, WorkDesk shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability to you for any claim shall not exceed the amount you paid to WorkDesk in the three months preceding the claim.
Termination
You may cancel your account at any time. We may suspend or terminate your account immediately for violations of these Terms. These Terms are governed by the laws of the State of Kentucky. Any disputes shall be resolved in the courts of Warren County, Kentucky.
